Web Site User Agreement

This Web Site is owned and operated by 98 Acres Resort & Spa, a company duly incorporated under the company laws of Sri Lanka, having its registered office at No. 76/1, Flower Road, Colombo 7, in the Democratic Socialist Republic of Sri Lanka (hereinafter, as and when the context so requires, called and referred to as “98 Acres Resort & Spa”).

By accessing and using this Web Site, booking our services or staying at the 98 Acres Resort & Spa, you agree to be bound by the terms and conditions of use, set out hereinbelow. That is, by using this Web Site, you will be deemed to have accepted these Terms and Conditions. The terms of online reservations will apply, when you make your reservations online, and shall form part and parcel of this Agreement. The Principles of Data Protection of 98 Acres Resort & Spa is also found here for your reference.

 

Reservations And Payments

  • All reservations must be confirmed via email or through our official booking channels.
  • For reservations of more than five rooms, please contact our Reservations Department directly at +94 112 050 050 or email us at info@resort98acres.com.
  • 50% advance payment is required at the time of booking, to confirm the reservation.
  • Guests are required to provide accurate contact details at the time of booking.
  • A confirmation email will be sent once the booking is finalized, and such confirmation is binding of the reservation.
  • This website accepts payments in Sri Lankan Rupees (Rs/LKR) and/or United States Dollars (US$) only.
  • By providing your credit/debit card information, you represent and warrant that: (i) you are legally entitled to, or authorized, to use the said card you provided; (ii) that 98 Acres Resort &
  • Spa is authorized to charge you in full for all charges incurred by you and/or your guests, for all products and services purchased by you and any damage or loss caused during your stay (including, but not limited to, 98 Acres Resort & Spa’s property); (iii) you authorize 98 Acres Resort & Spa to charge any cancellation charge from your card.
  • Please note that neither 98 Acres Resort & Spa nor the Hotel owning Company it represents on this website will be liable for any exchange rate losses/gain due to any transactions/refunds processed, irrespective of customer’s credit/debit card currency.
  • Please note that the bank transaction fee will be non-refundable under any circumstance, for online reservations.
  • Resident rate will be only valid for Sri Lankan Residents and Residence Visa Holders.

 

Room Rates

Room rates are inclusive of service charge and government levies and taxes applicable at the time of booking.

 

Default Cancellation Policy

  • In the event you do not utilize your reservation (no-show) or fail to cancel prior to the stipulated time period, there will be no refund granted.
  • More than 21 days: If the cancellation is notified more than 21 days prior to arrival date the deposit will be refunded, minus all the bank charges and fees.
  • 20 – 15 days: If the cancellation, or amendment to the booking, is notified 20 – 15 days prior to booked arrival date 50% of the basis booked for the total stay will be charged, and the remainder from the deposit, if any, would be refunded, minus all bank charges and fees.
  • Less than 14 days: If the cancellation, or amendment to the booking, is notified less than 14 days prior to booked arrival date 100% of the basis booked for the total stay will be charged.
  • Peak Period: For confirmed bookings during peak period (i.e., for any reservation which has a component that falls between 20th December to 10th January, and including both these dates), the standard cancellation policy will not be applicable. Cancellation of bookings during this period, no shows or guests reducing the period of stay will be charged 100% of the total invoice value.

 

Check-in / Check-out Policy

  • Check-in time: 2:30 PM
  • Check-out time: 11:30 AM
  • Early check-in or late check-out is subject to availability and may incur additional charges.

 

Child & Extra Bed Policy

  • Children 5.99 years of age and below stay free of charge.
  • Children 6 to 11.99 years of age will be charged as per child policy with or without extra bed.
  • Children above 12 years of age are considered as adults.
  • Extra beds are available on request and subject to availability. Additional charges apply.
  • Guests must supervise their children.

 

Special Requests

While we try to accommodate all guest preferences (e.g., specific room requests, dietary needs), these cannot be guaranteed and are subject to availability.

 

General Resort Policies

  • Smoking is strictly prohibited inside all rooms.
  • For the comfort and safety of all guests, no pets are allowed on the property.
  • Guests are responsible for their personal belongings. The resort is not liable for any loss, theft, or damage.
  • For the health, safety, and comfort of all guests, and to maintain the cleanliness of the swimming pool, all individuals must wear proper and appropriate swim attire when using the pool facilities.
  • Any arrangements and associated costs for driver/guide accommodation are the sole responsibility of the guest and the driver/guide. The hotel acts only as a facilitator by providing information and does not guarantee the availability, quality, or pricing of any external accommodation.

 

Intellectual Property

The Intellectual Property rights in all of the domain, branding, content, images and videos are owned by the 98 Acres Resort & Spa. Copying or usage of any part for commercial or business use is strictly prohibited, and your use of the Web Site does not grant, transfer, or confer upon you any right, title or interest in any such Intellectual Property.

 

Disclaimer

All reasonable security measures will be taken by 98 Acres Resort & Spa to secure your information, including your credit/debit card information and other personal details, you agree to hold 98 Acres Resort & Spa, and all its employees and officers harmless and release them from all actions, claims, liability, damage or loss that may result from any loss, compromise, release or disclosure of your credit/debit card information caused by malware attacks, phishing attacks, viruses, hacking activities, malicious software any other unlawful interference of the Web Site’s system or unauthorized access by third parties.

 

Governing Law And Disputes

The Terms and Conditions and any stay at the 98 Acres Resort & Spa shall be governed and construed in accordance with the laws of Sri Lanka, without any effect of conflict of laws rules or principles, and the Courts of Sri Lanka shall have jurisdiction over any dispute that may arise.

 

Force Majeure

In the event of any event that may reasonably be construed as force majeure, 98 Acres Resort & Spa reserves the right to refuse to perform its obligations, and shall hold no liability to any party for such refusal/failure, but shall undertake its best efforts to issue refunds in line with the terms set out above.

 

Amendment Of The Terms And Conditions

98 Acres Resort & Spa retains the full right to amend the Terms and Conditions without any prior notice, and your continued use of the Web Site after any such amendment constitutes your acceptance of the Amended Version of the Terms and Conditions.

If you do not agree to the Terms and Conditions or any Amended Version of the Terms and Conditions, please do not use this Web Site or our services, and cease your usage immediately.
